These General Conditions of Use of the Web Space do not confer on Users any other right of use, alteration, exploitation, reproduction, distribution, or public communication of the Web Space and/or its Content other than those expressly provided herein. Any other use or exploitation of any rights will be subject to the prior and express authorization specifically granted for that purpose by the DATA CONTROLLER or the third-party owner of the affected rights.

The User of this Web Space undertakes to respect the rights stated and to avoid any action that could harm them, reserving in all cases the DATA CONTROLLER the exercise of whatever means or legal actions correspond to it in defense of its legitimate intellectual and industrial property rights.

 

5. Obligations and responsibilities of the Web Space User

The User agrees to:

  • Make appropriate and lawful use of the Web Space as well as its contents and services, in accordance with: (i) the applicable legislation at any given time; (ii) the General Conditions of Use of the Web Space; (iii) generally accepted morals and good customs and (iv) public order.

  • Provide themselves with all the technical means and requirements needed to access the Web Space.

Notwithstanding the provisions of the previous section, the User must also refrain from:

  • Reproducing or copying, distributing, allowing public access through any form of public communication, transforming or modifying the contents, unless authorization is obtained from the owner of the corresponding rights or it is legally permitted.

  • Deleting, hiding, or manipulating notes on intellectual or industrial property rights and other identifying data of the rights of the DATA CONTROLLER or third parties incorporated into the contents, as well as technical protection devices or any information mechanisms that may be inserted into the contents.

  • Obtaining and attempting to obtain the contents using means or procedures other than those which, depending on the case, have been made available for this purpose or have been expressly indicated on the web pages where the contents are located or, in general, those habitually used on the Internet as they do not involve a risk of damage or disablement of the Web Space and/or its contents.

In particular, and by way of indication but not limitation, the User undertakes not to transmit, disseminate or make available to third parties information, data, content, messages, graphics, drawings, sound and/or image files, photographs, recordings, software and, in general, any kind of material that:

  • In any way is contrary to, disparages, or attacks fundamental rights and public freedoms recognized constitutionally, in International Treaties, and in all other applicable legislation.

  • Induces, incites, or promotes actions, attitudes, or thoughts that are discriminatory by reason of sex, race, religion, beliefs, age, or condition.

  • Incorporates, makes available, or allows access to products, elements, messages, and/or services that are criminal, violent, offensive, harmful, degrading, or, in general, contrary to the law, morals, and generally accepted good customs or public order. Induces or may induce an unacceptable state of anxiety or fear.

  • Induces or incites involvement in dangerous, risky, or harmful practices for health and psychological balance.

  • Is protected by legislation on intellectual or industrial protection belonging to the DATA CONTROLLER or third parties without the intended use having been authorized.

  • Is contrary to honor, personal and family privacy, or a person’s own image.

  • Constitutes any type of advertising.

  • Includes any type of virus or program that prevents the normal functioning of the Web Space.

If it is necessary to provide data to contact or use any communication channel of the Web Space, the User is obliged to provide truthful information. If the User negligently or intentionally breaches any of the obligations established in these General Conditions of Use, they will be liable for all damages and losses that may derive from such breach for the DATA CONTROLLER.

 

6. Responsibilities

Continued access, or the correct display, download, or utility of the elements and information contained in the web is not guaranteed, and may be prevented, hindered, or interrupted by factors or circumstances outside of its control. The DATA CONTROLLER is not responsible for decisions that could be made as a consequence of access to the content or information offered.

The service may be interrupted, or the relationship with the User terminated immediately, if it is detected that the use of the Web Space, or any of the services offered therein, is contrary to these General Conditions of Use. We are not responsible for damages, losses, claims, or expenses derived from the use of the Web Space.

The DATA CONTROLLER will only be responsible for deleting, as soon as possible, the content that may generate such damage, provided that it is so notified. In particular, we will not be responsible for damages that could derive, among others, from:

  • Interferences, interruptions, failures, omissions, telephone breakdowns, delays, blockages, or disconnections in the operation of the electronic system, caused by deficiencies, overloads, and errors in telecommunication lines and networks, or due to any other cause beyond the control of the DATA CONTROLLER.

  • Illegitimate intrusions through the use of malicious programs of any kind and through any means of communication, such as computer viruses or any others.

  • Improper or inappropriate abuse of the Web Space.

  • Security or navigation errors produced by a malfunction of the browser or by the use of non-updated versions of it. The administrator of the web space reserves the right to withdraw, totally or partially, any content or information present on the Web Space.

The DATA CONTROLLER excludes any liability for damages of any nature that may be due to the misuse of the freely available services and use by Users of the Web Space. Likewise, it is exonerated from any liability for content and information that may be received as a result of data collection forms, these being solely for the provision of inquiry and doubt services. On the other hand, in case of causing damages due to an illegal or incorrect use of said services, the User may be claimed for the damages caused.

You will hold the DATA CONTROLLER harmless against any damages arising from claims, actions, or demands of third parties as a consequence of your access or use of the Web Space. Likewise, you agree to indemnify against any damages arising from your use of “robots”, “spiders”, “crawlers” or similar tools employed for the purpose of gathering or extracting data or any other action on your part that imposes an unreasonable burden on the operation of the Web Space.

 

7. Hyperlinks

The User undertakes not to reproduce in any way, not even through a hyperlink, the Web Space, as well as any of its contents, unless express written authorization is given by the DATA CONTROLLER.

The Web Space may include links to other web spaces, managed by third parties, in order to facilitate the User’s access to information from collaborating projects. Accordingly, the DATA CONTROLLER is not responsible for the content of said web spaces, nor does it position itself as a guarantor and/or offering party of the services and/or information that may be offered to third parties through third-party links.

The User is granted a limited, revocable, and non-exclusive right to create links to the main page of the Web Space exclusively for private and non-commercial use. Web spaces that include a link to our Web Space (i) may not misrepresent their relationship or state that such a link has been authorized, nor include trademarks, trade names, company names, logos, or other distinctive signs of the DATA CONTROLLER; (ii) may not include content that could be considered tasteless, obscene, offensive, controversial, inciting violence or discrimination based on sex, race, or religion, contrary to public order or illegal; (iii) may not link to any page of the Web Space other than the main page; (v) must link to the Web Space’s own address, without allowing the linking web space to reproduce the Web Space as part of its website or within one of its “frames” or create a “browser” over any of the pages of the Web Space. The DATA CONTROLLER cannot control the information, content, products, or services provided by other web spaces that have established links to the Web Space.

 

8. Data Protection (Privacy Policy)

In accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018 (LOPDGDD), the DATA CONTROLLER informs Users that any personal data collected through contact emails, forms, or navigation will be treated with absolute confidentiality.

  • Data retention: Data will be kept for as long as necessary to resolve the inquiry or maintain the professional relationship, and subsequently during the legally required periods to meet potential liabilities.

  • Recipients: Data will not be transferred to third parties, except under legal obligation or to essential technical service providers (such as the web hosting platform) located within the European Economic Area.

  • Users’ Rights: Users may exercise their rights of access, rectification, erasure (deletion), restriction of processing, data portability, and objection at any time. 11. Force majeure

The DATA CONTROLLER will not be responsible in any case for the impossibility of providing service if it is due to prolonged interruptions of the electricity supply, telecommunication lines, social conflicts, strikes, rebellion, explosions, floods, acts and omissions of the Government, and in general all cases of force majeure or fortuitous events.

 

12. Resolution of disputes. Applicable law and jurisdiction

These General Conditions of Use, as well as the use of the Web Space, shall be governed by Spanish legislation. For the resolution of any dispute, the parties will submit to the Courts and Tribunals of the registered address of the Website Controller (Madrid, Spain).

In the event that any provision of these General Conditions of Use should be unenforceable or void by virtue of applicable legislation or as a consequence of a judicial or administrative resolution, such unenforceability or nullity will not make these General Conditions of Use unenforceable or void as a whole. In such cases, the DATA CONTROLLER will proceed to modify or replace said provision with another that is valid and enforceable and that, as far as possible, achieves the objective and pretension reflected in the original provision.
